Overtime may only be performed on a voluntary basis. 2.5 Freedom of Association The right of employees to establish and join organisations of their choice, to engage in collective bargaining and to take industrial action shall be fully respected. Where freedom of association and the right to collective bargaining are legally restricted, alternative means of independent and free association of employees for the purpose of collective bargaining shall be provided. Any disadvantage arising from the establishment of, membership in or participation in an employee organisation is strictly prohibited. Employee representatives must be granted free access to the workplaces of their colleagues to ensure that they can exercise their rights in a lawful and peaceful manner. 2.6 Prohibition of Discrimination Any form of unequal treatment of employees is prohibited unless objectively justified by the requirements of employment. This includes, in particular, discrimination on the grounds of gender, gender identity, national, ethnic or social origin, skin colour, disability, state of health, political opinion, belief, religion, age, pregnancy or sexual orientation. The prohibition of discrimination expressly extends to equal pay for work of equal value. The personal dignity, privacy and individual rights of each person must be respected. Any form of discrimination, intimidation, harassment or unjustified disadvantage in the workplace is strictly prohibited. 2.7 Occupational Health and Safety The Business Partner is responsible for ensuring a safe and healthy working environment. To this end, effective occupational health and safety systems must be established and implemented in order to prevent accidents and work-related health risks. Excessive physical or mental strain must be avoided through appropriate measures. During the performance of work and services for the WALTER GROUP, the consumption and possession of alcohol and drugs in the workplace are strictly prohibited. Employees must also be regularly informed of and trained in, applicable health and safety standa rds and measures. Furthermore, access to clean drinking water in sufficient quantity, as well as to hygienic sanitary facilities, must be guaranteed at all times. 2.8 Preservation of Natural Resources The Business Partner shall neither appropriate nor use land, forests or water in any manner that violates applicable laws or legitimate rights or that impairs peoples livelihoods. Any adverse impacts on human rights or the environment must be avoided. This particularly includes harmful practices such as soil degradation, water or air pollution, excessive water consumption or significant noise pollution that substantially restrict agricultural production or hinder access to clean drinking water and adequate sanitation.
